EPA Issues New Guidance on MTR Permits

The EPA has released its plans for regulations to reduce the impact of mountaintop removal mining in Appalachian states.

Administrator Lisa Jackson announced today that the agency is issuing comprehensive guidance to its regional offices, with benchmarks for preventing damage to streams and communities near mining activity.

The guidance details how the agency will use its authority under the Clean Water Act and identifies how mining companies can improve practices and operations.

The agency also released two draft reports. One sets a new benchmark for salt content in Appalachian surface waters, and the other details the environmental and water quality impacts of mountaintop mining and valley fills.

The move comes less than a week after the agency vetoed an Army Corps of Engineers valley fill permit for Arch Coal's Spruce No. 1 surface mine in West Virginia. EPA says the project would have buried more than seven miles of streams and damaged water quality in nearby areas.
